Terms of Service

1. Introduction & Acceptance

By accessing or using Foundrs ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

You must be at least 13 years of age to use Foundrs. By using the Service, you represent and warrant that you meet this age requirement.

2. Description of Service

Foundrs is an AI-powered content generation platform for X/Twitter and LinkedIn. The Service generates posts that match your unique writing voice using our WritingDNA technology. Key features include:

• AI content generation matching your writing style
• Post scheduling and publishing
• Product and brand management for content topics
• Writing profile analysis (WritingDNA)

Foundrs is a subscription-based service with the following tiers: Trial, Starter, Creator, and Pro.

3. Account Registration & Security

• Accounts are created via X/Twitter OAuth, Apple Sign-in, or Google Sign-in
• Email verification is required to use the Service
• You are responsible for maintaining the security of your account
• You must not share your credentials or allow unauthorized access to your account
• You must provide accurate and current information

4. Social Media Account Connection

By connecting your social media accounts, you authorize Foundrs to:

• Access your profile information via OAuth 2.0
• Post content to your accounts on your behalf

Important details:

• We do not store your social media passwords
• OAuth tokens are stored encrypted in platform-secure storage
• You can disconnect any social account at any time
• You are responsible for compliance with each platform's terms of service

5. Subscriptions & Payments

Foundrs offers the following subscription tiers:

Each combination of account and product has its own independent schedule. The posts/day limit shown above applies per schedule. For example, on the Starter tier (1 account, 1 product), each has its own schedule of up to 3 posts/day, allowing up to 6 total posts per day.

• Payments are processed by Stripe; we do not store payment card details
• Subscriptions automatically renew at the end of each billing period (monthly or annual) at the then-current price unless cancelled
• You may cancel at any time through the app; cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods
• We reserve the right to change pricing with 30 days' notice

6. AI-Generated Content — Ownership & Responsibility

• You retain ownership of all inputs you provide (writing samples, prompts, product descriptions)
• You own the AI-generated output content
• You warrant that you have the right to all content you input
• We do not use your inputs or outputs to train AI models

7. Acceptable Use Policy

You must not use the Service to generate:

• Spam or unsolicited bulk content
• Malicious, harassing, or hateful content
• Defamatory or libelous content
• Content that infringes third-party intellectual property
• Content that violates social media platform policies
• Misleading or fraudulent content
• Content that exploits minors

You must not:

• Attempt to circumvent rate limits or access controls
• Reverse engineer the Service
• Use automated bots beyond normal app usage
• Impersonate others
• Share account credentials

Violation of this policy may result in immediate account suspension or termination.

8. Intellectual Property

The Foundrs service, branding, technology, and AI systems are our intellectual property. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

DMCA Takedown Notices

If you believe content on the Service infringes your copyright, contact nizar@foundrs.app with a DMCA takedown notice including:

• Identification of the copyrighted work
• Identification of the infringing material
• Your contact information
• A statement of good faith belief
• A statement under penalty of perjury
• Your physical or electronic signature

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant:

• Uninterrupted or error-free service
• Accuracy of AI-generated content
• Availability of third-party services (X/Twitter, LinkedIn, AI providers)
• That content will achieve your desired results

To the maximum extent permitted by law, our total liability shall not exceed the total amount paid by you in the 12 months preceding the claim.

We exclude liability for indirect, incidental, special, consequential, and punitive damages, including but not limited to: AI content inaccuracies, social media platform changes or outages, third-party API failures, user failure to review content before posting, and loss of social media followers or reputation.

10. Indemnification

You agree to indemnify, defend, and hold harmless Foundrs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from:

• Content posted via the Service
• Your violation of these Terms
• Your violation of social media platform policies
• Infringement of third-party rights
• Misuse of connected social accounts

11. Account Termination & Deletion

• You may delete your account at any time through the in-app settings
• We may suspend or terminate accounts for violations of these Terms
• Upon deletion, all your data is removed per our Privacy Policy (Stripe customer, Pinecone vectors, MongoDB records, Firebase Auth, local storage)
• Some data may be retained as legally required (e.g., financial records, fraud prevention)

12. Apple App Store & Google Play Provisions

The following additional terms apply when you access Foundrs through a mobile application:

• This agreement is between you and Foundrs, not Apple Inc. or Google LLC
• The license granted is non-transferable and limited to devices you own or control. Family Sharing is permitted per Apple's policies
• Foundrs is solely responsible for maintenance and support of the application; Apple and Google have no support obligation
• Foundrs is responsible for product claims, including product liability and legal compliance
• Foundrs is responsible for the investigation and defense of any third-party intellectual property infringement claims
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government prohibited parties list
• You must comply with applicable third-party agreements (e.g., wireless data service terms)
• Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them

13. Service Availability & Force Majeure

We strive for continuous availability but do not guarantee uptime. We are not liable for interruptions caused by third-party service outages, planned maintenance, or force majeure events including natural disasters, government actions, pandemics, or other circumstances beyond our reasonable control.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions.

• Arbitration: Disputes shall be resolved by binding arbitration administered by JAMS in the State of California
• Exceptions: Either party may seek injunctive relief in court for intellectual property violations or data breaches
• Class Action Waiver: All disputes must be resolved on an individual basis, not as class actions
• Small Claims: Either party may bring qualifying claims in small claims court

15. Changes to Terms

We may update these Terms from time to time. We will provide at least 30 days' notice of changes via email or in-app notification. Continued use of the Service after the effective date of changes constitutes your acceptance. Material changes may require re-acceptance.
